PRESIDENT DONALD Trump's reelection campaign is suing New Jersey over the state's decision to use a hybrid model for voting in November's election.

New Jersey Gov. Phil Murphy issued an executive order allowing residents to mail in a ballot or vote in person for the election due to the coronavirus pandemic. The order calls on officials to mail all registered voters in the state a ballot beginning Oct. 5 along with a prepaid return envelope.

Donald J. Trump for President, the Republican National Committee and the New Jersey Republican State Committee filed a lawsuit to have the order declared unlawful and overturned. The lawsuit claims that the Democratic governor's order is a "direct usurpation" of the state's legislature under the Constitution, which sets "the time, place and manner of congressional elections and to determine how the state chooses electors for the presidency."

"In a direct usurpation of the legislature's authority, Gov. Murphy issued Executive Order 177 purporting to rewrite the election code for the November 2020 election," the lawsuit states. "This brazen power grab was not authorized by state law and violates both the Elections Clause and Electors Clause of the U.S. Constitution."

The lawsuit claims that a universal vote-by-mail system "has created a recipe for disaster." Trump has repeatedly claimed that mail-in voting will result in fraud, and the lawsuit states that "fraudulent and invalid votes dilute" those of "honest citizens."

New Jersey is one of nearly a dozen states that will mail ballots to registered voters for the election, and the Trump campaign sued Nevada earlier this monthchallenging the state's law that will send mail-in ballots to voters.
